  • Hazard Duty Pay Lawsuit

    Good Afternoon Brothers & Sisters,


    Our Local E-board wanted to take this opportunity to let you all know that the Union has been researching the Hazardous Duty Pay issue due to COVID-19.  The Union has brought this to Management’s attention during the Warden/AW's meetings and during various conversations. We have spoken to the law firm McGILLIVARY STEELE ELKIN LLP, and are pleased to announce that MSE is now representing LOCAL 0222 UNION MEMBERS ONLY in a Hazardous Duty Pay case!  

    If we should prevail in this case, the violations would be covered under the Back Pay Act and the Fair Labor Standards Act. The attorneys will seek through the lawsuit payments of Hazardous Duty Pay and/or Environmental Differential Pay and interest that were not paid by Management from the beginning of the COVID-19 pandemic until there is no longer a hazardous situation. You must sign up to be eligible to participate in any monetary recovery resulting from the lawsuit.

    If you are approached by any Management official asking you to sign anything that states that they have paid you all your wages in full and you are satisfied with your current rate of pay DO NOT SIGN IT, as this may preclude you from being eligible for any lawsuit filed by AFGE Local 0222 or MSE.

    Attached is the ATTORNEY RETAINER FORM, and a UNION APPLICATION. The Union is prepared to ensure that all UNION MEMBERS receive the pay that you are ENTITLED to. The Union believes that Hazardous Duty Pay, unpaid overtime, and interest and/or liquidated damages is what every employee at FMC Devens is entitled to.

    ALL RETAINER FORMS MUST BE FILLED OUT AND DIRECTLY SUBMITTED TO THE LAW FIRM McGILLIVARY STEELE ELKIN LLP. Please fill out all forms using your PERSONAL EMAIL, NOT your work email! Forms can be submitted through the electronic DocuSign link at https://na4.docusign.net/Member/PowerFormSigning.aspx?PowerFormId=3c0cd8ee-a74d-442f-b874-4a0b3993ad9f&env=na4&acct=155d00b5-dc1a-409f-8470-1761ba2fdd03&v=2, or by printing, completing, and emailing the form to info@mselaborlaw.com.  ALL FORMS MUST BE COMPLETELY FILLED OUT TO BE ELIGIBLE!

    If you would like to be REPRESENTED by MSE you must be a UNION member and MAINTAIN your membership prior to turning in your RETAINER FORM and THROUGHOUT the complete process until the issue has been resolved and payment has been made. ANY staff member may join the Union. If you are a non-bargaining or Management Official you are still permitted to join the Union and be eligible for the union benefits. HOWEVER, YOU CANNOT BE REPRESENTED BY THE UNION, OR PARTICIPATE IN ANY VOTES OR UNION MEETINGS, AND YOU WILL NOT RECEIVE ANY COURTESY E-MAILS SENT TO BARGAINING UNIT MEMBERS.
