  • Understanding the Government Employee Fair Treatment Act During the Shutdown

    As the government shutdown continues, we want to clarify what the Government Employee Fair Treatment Act of 2019 means for you.

    As the law reads now, it guarantees that all federal employees—whether furloughed or working without pay—will receive full back pay once the government reopens. This law does not expire and applies to the current shutdown.

    Here’s what you should know:

    • Back Pay Is Guaranteed: You will be paid retroactively for the time you were furloughed or worked without pay.

    • Leave Usage:

      • Furloughed employees cannot use paid leave (such as annual or sick leave) during the shutdown.

      • Employees who are working may use leave if approved by their agency.

    • Leave Accrual: You will continue to earn annual and sick leave during the shutdown, even if furloughed.

    However, we must acknowledge that this administration has not always consistently followed established law or precedent. While the law remains in effect, implementation may vary, and we are closely monitoring how agencies apply these provisions.
